Civil Claims After a Rideshare Assault: How They Work

When someone is assaulted during an Uber ride, the conversation typically centers on the driver and the criminal system. That is only part of the picture.

A civil claim is filed by the survivor, through counsel, against the parties responsible for the harm. It runs separately from any criminal case, operates under a lower burden of proof, and can move forward whether or not criminal charges were ever filed or prosecuted.

Civil claims arising from rideshare assaults are viable even if:

  • Criminal charges were never filed, were reduced, or did not result in a conviction
  • The assault was not reported to law enforcement, or was reported but not pursued
  • Time has passed since the incident

Uber itself may also be part of the case. The company generally argues that drivers are independent contractors and that it bears no responsibility for their conduct. 

Civil claims rest on a different theory: Uber controls who drives on its platform, manages screening, handles complaints, and profits from every ride. When those systems fail and a passenger is harmed, the company may face liability alongside the individual driver. Thousands of survivors have pursued that theory in courts across the country, and consolidated federal proceedings are actively testing the scope of platform liability.

Platform Liability: What We Examine

Sexual assault cases involving rideshare services are negligence cases. The central issue is whether preventable safety failures contributed to the assault or made it harder to address afterward. Our investigation typically covers:

  • Driver Screening and Credentialing. Whether Uber's background check process was adequate for the risks involved, and whether gaps allowed a dangerous driver to remain active on the platform.
  • Prior Complaints and Warning Signs. Whether earlier reports or red flags existed in connection with the driver or account, and whether Uber acted on that information or allowed the driver to continue operating.
  • Platform Safety Features and Design. Whether in-app safety tools were functional, accessible, and meaningfully protective — and whether design decisions left passengers more exposed, particularly on late-night rides.
  • Monitoring and Enforcement. Whether Uber's stated safety policies were followed in practice, or whether drivers with known concerns remained active on the platform.
  • Post-Incident Response. Whether Uber preserved trip records, documented the complaint appropriately, and responded in a way that prioritized the survivor's safety rather than limiting the company's exposure.
