Building Collapse Accidents

Seattle Building Collapse Lawyer

Structure, Wall, Excavation, and Demolition Collapse Claims

Bishop Legal represents workers and families after serious building collapse accidents in Washington. We handle claims involving structure collapses, wall collapses, floor and roof failures, excavation-related collapses, demolition accidents, temporary support failures, and unsafe construction sites.

When a building or structural element fails, injured workers may be told to file an L&I claim and move on. That may leave major recovery on the table. If a contractor, subcontractor, engineer, property owner, developer, public entity, equipment company, or other third party contributed to the collapse, a separate personal injury claim may be available.

Our construction accident work includes:

  • $25M settlement — Concrete worker brain injury and permanent disability
  • $1M settlement — Drywall installer injured in faulty scaffolding fall
  • $800K settlement — Steel worker injured on WSDOT overpass project

We represent injured workers in serious collapse claims with the experience these cases require: construction litigation, public project claims, contractor liability, unsafe site conditions, and third-party injury recovery.

Building Collapse Cases We Handle

Building collapse claims are not limited to complete structural failures. A partial collapse can be enough to crush, trap, strike, bury, or severely injure workers.

Bishop Legal handles claims involving:

  • Wall collapse accidents
  • Floor, roof, ceiling, and deck collapses
  • Demolition accidents and debris collapses
  • Excavation-related structure failures
  • Formwork, shoring, and temporary support failures
  • Scaffold, platform, and lift-related collapses
  • Collapses during renovation, repair, or retrofit work
  • Falling structural components, panels, beams, masonry, or concrete

These cases often involve workers from several trades performing different tasks in the same area. A laborer, carpenter, electrician, concrete worker, ironworker, roofer, or demolition worker may be injured by unsafe decisions made by another company.

Why Buildings and Structures Collapse on Construction Sites

Construction and demolition work can expose weaknesses that are not always visible from the outside. Walls may be unsupported. Floors may be overloaded. Temporary bracing may be missing or improperly installed. Excavation work may undermine a foundation. Demolition sequencing may place workers in the path of falling materials.

Common causes of collapse accidents include:

  • Failure to brace, shore, or support walls and structural components
  • Unsafe demolition sequencing
  • Cutting or removing load-bearing elements too early
  • Overloaded floors, decks, platforms, or scaffolds
  • Excavation work that destabilizes nearby structures
  • Poor engineering, inspection, or safety planning
  • Inadequate communication between trades
  • Defective equipment, fasteners, forms, or support systems
  • Failure to stop work after warning signs appear

A collapse usually has a history. The investigation should examine the planning, supervision, drawings, site changes, inspections, and decisions that came before the failure.

Civil Claims Beyond Workers’ Compensation

Workers injured in collapse accidents may qualify for L&I benefits. Those benefits can help with medical care and partial wage replacement, but they do not cover the full impact of a serious injury.

A third-party civil claim may allow recovery for damages workers’ compensation does not provide, including pain and suffering, full loss of earning capacity, loss of enjoyment of life, and long-term consequences of permanent disability.

A civil claim may be available when the collapse was caused or worsened by:

  • A general contractor’s failure to coordinate work safely
  • A subcontractor’s unsafe demolition, framing, excavation, or structural work
  • An engineer’s, architect’s, or inspector’s failure to address a known hazard
  • A property owner’s or developer’s control over unsafe site conditions
  • A public entity’s role in a municipal, transportation, school, port, or utility project
  • A manufacturer’s or rental company’s defective equipment or support system

A worker can have an L&I claim and still pursue a third-party civil claim against companies or entities outside the direct employer relationship.

Who May Be Liable for a Building Collapse Accident?

Liability depends on control. These cases require a close look at who designed the work, who approved changes, who controlled the schedule, who inspected the structure, who performed the demolition or excavation, and who had authority to stop unsafe work.

Potential defendants may include:

  • General contractors. General contractors may be responsible for site-wide safety, trade coordination, sequencing, and WISHA compliance on multi-employer job sites.
  • Demolition contractors. Demolition work requires careful sequencing, controlled debris removal, and protection for workers in and around the structure. Unsafe demolition methods can create direct liability.
  • Excavation and foundation contractors. Digging near buildings, retaining walls, sidewalks, trenches, or utilities can destabilize surrounding structures if proper support is not used.
  • Engineers, architects, and safety consultants. Design professionals and consultants may be involved when defective plans, missed warnings, unsafe recommendations, or failed inspections contributed to the collapse.
  • Property owners and developers. Owners and developers may share responsibility when they retain control over the project, approve unsafe work, or fail to address known structural hazards.
  • Public entities. Collapses on public works projects may involve cities, counties, state agencies, ports, schools, transportation departments, or utility districts. These claims have special procedural rules.

Demolition Accidents and Partial Structure Failures

Demolition accidents are a major part of building collapse litigation. Workers may be injured when walls fall outward, roofs fail, floors give way, or debris falls into active work areas.

These claims often involve questions such as:

  • Was the demolition sequence planned and followed?
  • Were load-bearing walls, beams, or supports removed safely?
  • Were workers kept away from collapse zones?
  • Were temporary supports or braces installed before demolition continued?
  • Did nearby excavation, vibration, or heavy equipment contribute to the failure?
  • Were warning signs ignored before the structure gave way?

A demolition accident may involve the demolition contractor, general contractor, property owner, engineer, equipment operator, or other companies working on the same project.

Filing Deadlines in Washington Collapse Cases

Most Washington personal injury claims must be filed within three years. Washington law also has claim procedures for certain government defendants, including a 60-day waiting period before filing suit after proper notice in local government claims.

Deadlines can be affected by public projects, wrongful death claims, defective equipment issues, L&I reimbursement rights, and other case-specific facts. Because collapse sites change quickly, early review is important.
