Bishop Legal Files Lawsuit After Baggage Tug Crash Injures Ramp Worker at SeaTac

What Happened on the Tarmac

The incident occurred on July 9, 2024, during a busy operational period near an active gate, where multiple ground service vehicles and personnel were working to prepare for an arriving flight. According to reports, the ramp area had become crowded with equipment and vehicles.

Our client, Marcus Creary, was actively working to help clear space near Gate B1 when a baggage tug pulling a cart moved through the congested area. In the course of that movement, the tug and cart made contact with our client, resulting in serious injuries.

Creary explained, “There was a lot of traffic coming in, there was clutter at the gate, and we needed to clear that up for a safe environment.”

After he was struck by the baggage tug, firefighters were sent to assess the severity of his injuries. He was sent home with just some ice and a reminder to be more careful. However, Creary now suffers from chronic nerve damage and complex regional pain syndrome (CRPS), indicating that the initial assessment and treatment he received were insufficient.

Allegations of Unsafe Conditions and Safety Failures

Our attorneys filed Creary’s lawsuit against the Port of Seattle, PrimeFlight Aviation Services, Swissport USA, and Swissport Fueling. We allege that safety failures outside of Creary’s control contributed to the crash.

The safety failures that led to our client’s injury, we allege, can be summed up as:

  • Congestion in the gate area caused by vehicles and equipment that should not have been present, including a Swissport vehicle
  • Improperly positioned or parked equipment interfering with safe operations
  • A failure by vehicle operators to maintain a proper lookout and safe distance
