Excavation and Cave-In Injury Claims
Bishop Legal represents workers and families after serious trench collapse, excavation cave-in, and construction site injury accidents in Washington. Our firm handles third-party claims involving unsafe job sites, contractor negligence, public works projects, utility work, defective equipment, and failures to follow excavation safety rules.
Workers injured in trench collapses are often told to file an L&I claim and stop there. That may not be the full picture. If a company other than your direct employer helped cause the collapse, you may have a separate civil claim for damages workers’ compensation does not provide.
We are a construction injury firm with the record, experience, and litigation background serious trench collapse cases require.
- Millions recovered for workers injured in construction and job-site accidents
- Precedent-setting victories in Vargas and Afoa cases that helped strengthen worker protections and contractor liability standards
- Decades of experience handling construction, workplace, public project, and third-party injury claims
Our Seattle trench collapse attorneys are available 24/7 and collect no legal fees unless we win. Call (206) 260-3316 or contact us online for a FREE consultation. Se Habla Español.

I’ve seen other friends works with different attorneys for similar situations and their experience was no where near as great as how I was taken care of with Bishop. I worked with two different paralegals during my settlement process with Bishop Legal and both were incredibly helpful. Thanks, Nicia and Dairely!!”- Tiffany W.

Trench Collapse Cases Demand Experienced Counsel
Trench collapse claims are technical, urgent, and heavily defended. Contractors and insurers often dispute who controlled the excavation, whether the trench protection was adequate, and whether the injured worker or employer bears responsibility.
Bishop Legal has the experience to evaluate those issues. Our firm has handled construction accident claims involving unsafe site coordination, contractor negligence, public projects, equipment hazards, and catastrophic harm to workers. We know how to investigate multi-employer job sites and pursue claims against the responsible companies.
Examples of our results include:
- $25M settlement — Concrete worker brain injury and permanent disability
- $1M settlement — Drywall installer injured in faulty scaffolding fall
- $800K settlement — Steel worker injured on WSDOT overpass project
- $450K settlement — Catastrophic construction laborer injury

How Trench Collapse Accidents Happen
A trench can fail quickly. Once soil gives way, a worker may have only seconds to react. Even a shallow collapse can create enough force to trap, crush, or suffocate a worker.
Trench and excavation accidents may involve:
- Missing or inadequate trench boxes
- Failure to shore, shield, bench, or slope the excavation
- Heavy equipment operating too close to trench edges
- Spoil piles placed too close to the excavation
- Water accumulation or unstable soil conditions
- Vibration from nearby traffic, machinery, or utility work
- Lack of safe access and exit points
- Failure to inspect the trench after weather, vibration, or changed conditions
These cases often require a close review of excavation plans, competent-person inspections, soil classifications, safety meetings, equipment placement, and contractor responsibilities.
Workers’ Compensation and Third-Party Trench Collapse Claims
Most injured construction workers can file an L&I claim after a job-site accident. L&I may cover medical care, partial wage replacement, and certain disability benefits.
A third-party claim is different. It is a civil claim against a person or company other than the worker’s direct employer. These claims can seek compensation workers’ compensation does not provide, including pain and suffering, full loss of earning capacity, loss of enjoyment of life, and the long-term consequences of permanent disability.
A trench collapse may support a third-party claim when:
- A general contractor failed to enforce excavation safety rules
- An excavation subcontractor created or ignored unsafe trench conditions
- A utility company contributed to unsafe digging, sequencing, or site pressure
- A property owner or developer retained control over the worksite
- An engineer, safety consultant, or inspector failed to address known hazards
- A public entity controlled or contributed to the project
- Defective equipment contributed to the collapse or injury
A worker can have both an L&I claim and a third-party civil claim. A separate civil claim focuses on the companies or entities whose work, control, or safety failures helped cause the collapse.

Filing Deadlines
Most Washington personal injury claims must be filed within three years. Trench collapse cases can involve additional timing issues, especially when a project involves a city, county, state agency, port, transportation department, public utility, or other government entity.
Government claims may require formal notice before a lawsuit can be filed. Product-related issues, wrongful death claims, and L&I reimbursement rights may also affect how the case is handled.
Because excavation sites change quickly, early legal review is important. The sooner the investigation begins, the easier it is to preserve evidence, identify responsible parties, and protect the worker’s right to pursue claims outside the workers’ compensation system.
